Website Disclaimer

Last Updated: September 8, 2026

1. Educational Content; Not a Brokerage or Legal Service

Nextgen Homeowners (“Nextgen,” “we,” “us,” or “our”) provides general educational information and may, in certain transactions, act as a principal holding an assignable contractual interest in residential real property agreements, including lease-option or similar agreements.

Nextgen is not a real estate brokerage and does not act as a real estate agent, real estate broker, property manager, mortgage lender, loan originator, mortgage broker, appraiser, attorney, tax professional, financial adviser, investment adviser, or credit repair organization. Nextgen does not represent buyers, sellers, landlords, tenants, borrowers, or other parties in real estate transactions and does not act in a fiduciary capacity for any user, customer, owner, landlord, tenant, buyer, tenant-buyer, prospective assignee, or other party.

Nothing on this website, in our communications, or in our educational materials constitutes legal, brokerage, lending, tax, credit-repair, appraisal, investment, or financial advice. You should obtain independent advice from qualified Arizona professionals before signing any agreement, making any payment, entering a lease, acquiring an assignment, exercising an option, or pursuing a purchase of real property.

2. Principal-Only Transactions; Assignable Contractual Interests

Nextgen does not list real property on the Multiple Listing Service (“MLS”), market or advertise real property on behalf of owners, collect real estate commissions, act as an agent for owners or prospective buyers, or represent clients in real estate transactions.

When Nextgen markets a specific opportunity, Nextgen may be acting solely as a principal that holds an assignable contractual or equitable interest under an underlying agreement relating to a property. Nextgen may market and, where permitted by the applicable agreement and law, assign its own contractual interest to a third party.

Nextgen may not own, and may not hold legal title to, a property referenced on this website, in advertising, in educational materials, or in communications. An assignment of Nextgen’s contractual interest is not a sale by Nextgen of the real property itself and does not, by itself, transfer legal title to the property.

Any prospective assignee’s rights are limited to and governed by the underlying agreement, the assignment agreement, applicable law, property-owner or landlord requirements, title, property condition, financing requirements, and any other stated conditions.

3. No Representations Regarding Properties or Transactions

Information about a property, lease-option opportunity, assignment opportunity, owner, landlord, neighborhood, rent, purchase price, option consideration, rent credits, estimated payment, financing, taxes, insurance, HOA, repairs, condition, title, liens, zoning, square footage, schools, market value, appreciation, or other matter may be incomplete, inaccurate, outdated, or subject to change.

Nextgen does not independently guarantee or warrant the accuracy, completeness, legality, availability, financeability, marketability, condition, value, title status, lien status, insurability, eligibility, or suitability of any property or transaction.

Prospective assignees, tenant-buyers, buyers, tenants, landlords, and owners are solely responsible for conducting their own due diligence. This may include obtaining independent legal advice, title review, lien review, inspection, appraisal, survey, insurance review, HOA review, financing review, and tax advice before signing an agreement or making a payment.

4. Assignment Fees, Option Consideration, Rent Credits, and Other Payments

Any payment made to Nextgen and identified in writing as an assignment fee is consideration paid to Nextgen for the assignment of Nextgen’s contractual interest, if any. Unless a written agreement specifically states otherwise, an assignment fee paid to Nextgen is not:

A purchase of real property.

A down payment toward the property purchase price.

A payment made to the owner or landlord.

Earnest money.

A security deposit.

Prepaid rent.

Option consideration paid to the owner or landlord.

A rent credit.

A guarantee of financing, occupancy, option exercise, purchase, title transfer, equity, appreciation, or financial benefit.

All parties should carefully review the applicable written agreements to understand the amount, recipient, purpose, refundability, credit treatment, deadlines, default provisions, and conditions applicable to any assignment fee, rent payment, security deposit, option consideration, rent credit, earnest money, or other payment.

Nextgen does not guarantee that any payment will be refundable, credited toward a future purchase, or retained by any party. Payment obligations and rights are controlled solely by the applicable written agreements and applicable law.

5. No Guarantees; No Mortgage or Credit-Repair Promises

All information, tools, templates, resources, and materials on this website are provided on an “as is” and “as available” basis for general informational purposes.

Nextgen makes no express or implied representation, warranty, or guarantee regarding:

The availability of any property, assignment, lease-option, seller-financing arrangement, owner participation, or landlord approval.

The ability of any person to obtain a lease, assignment, option, mortgage loan, seller financing, title, rent credit, purchase right, or ownership interest.

Qualification for financing, credit score improvement, credit repair, debt reduction, income qualification, purchase timeline, future home value, appreciation, equity, investment return, or financial outcome.

A landlord’s willingness to sell, lease, approve a tenant, consent to an assignment, honor an option, or complete a future sale.

The outcome, validity, enforceability, performance, or completion of any real estate transaction.

No statement made on this website, through advertising, in a testimonial, in a course, by email, by text message, by phone, or in any other communication should be understood as a promise or guarantee of a particular outcome.

6. Your Responsibility; Independent Professional Advice

Before signing any contract or making any payment related to real property, you should obtain independent advice from professionals appropriate to your situation, which may include:

An Arizona real estate attorney.

A licensed Arizona real estate professional.

A mortgage lender or loan originator.

A title or escrow company.

A qualified home inspector.

An appraiser.

An insurance professional.

A CPA or tax adviser.

A qualified financial adviser.

You should not rely solely on Nextgen’s website, advertising, educational materials, communications, property summaries, templates, illustrations, calculators, testimonials, estimates, or statements in deciding whether to enter a lease, lease-option, assignment, seller-financed transaction, purchase, or other real estate transaction.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Nextgen, its owners, members, managers, employees, contractors, affiliates, licensors, and service providers will not be liable for any direct, indirect, incidental, special, consequential, exemplary, punitive, or other damages, losses, costs, claims, liabilities, disputes, or expenses arising from or related to:

Use of or inability to use this website, educational materials, tools, templates, resources, or communications.

Reliance on information provided by Nextgen or third parties.

Any lease, lease-option, assignment, seller-financing transaction, purchase, attempted purchase, tenancy, occupancy, financing application, credit outcome, property condition, title matter, dispute, default, eviction, foreclosure, loss of payment, loss of credit, or failure to close.

Any action or inaction by a property owner, landlord, tenant, buyer, assignee, lender, title company, inspector, attorney, broker, contractor, HOA, government entity, or other third party.

Nothing in this Disclaimer is intended to limit liability that cannot legally be limited under applicable law.

8. Third-Party Services and Links

This website may link to or reference third-party websites, products, services, platforms, lenders, inspectors, title companies, attorneys, credit-building resources, educational resources, or other providers. Such links and references are offered solely for convenience and informational purposes.

Nextgen does not control, endorse, guarantee, supervise, or assume responsibility for third-party information, availability, conduct, services, products, pricing, qualifications, outcomes, privacy practices, security practices, or legal compliance.

You are responsible for independently evaluating any third party before providing information, entering an agreement, making a payment, or relying on that third party’s services.

If Nextgen receives compensation, an affiliate payment, or another material benefit related to a third-party relationship, Nextgen will disclose that relationship where legally required.

9. Consumer Protection and Fair Housing

Nextgen intends to operate in compliance with applicable consumer-protection and fair-housing laws. Nothing on this website is intended to express a preference, limitation, or discrimination based on race, color, religion, sex, national origin, familial status, disability, or any other legally protected characteristic.

Property availability, landlord decisions, tenant screening, financing decisions, and transaction terms may be subject to applicable law and the lawful policies of the relevant owner, landlord, lender, HOA, insurer, or other third party.

Unless otherwise stated, all website content, logos, branding, text, graphics, videos, guides, educational materials, tools, templates, downloads, and other content made available by Nextgen are owned by or licensed to Nextgen and are protected by applicable intellectual-property laws.

You may use materials purchased or provided by Nextgen solely for your personal, noncommercial use. You may not copy, reproduce, distribute, modify, publish, display, transmit, sell, sublicense, reverse engineer, create derivative works from, or commercially exploit Nextgen materials without Nextgen’s prior written permission.

11. Privacy and Data Use

Do not submit sensitive information—including Social Security numbers, bank-account details, full credit reports, tax returns, driver’s-license information, or other highly sensitive personal or financial information—through this website or by unsecured email or text unless Nextgen specifically provides a secure method for doing so.

Nextgen does not sell or misrepresent personal information in a manner inconsistent with its Privacy Policy. You are responsible for reviewing the Privacy Policy before submitting information through this website.

12. Changes to This Disclaimer

Nextgen may revise this Disclaimer at any time. The revised version becomes effective when posted on this website, unless a different effective date is stated.
